CALL TO ORDER AND
OPENING PRAYER
Chairman Rockstroh called the
meeting to order at 8:45 a.m. and Gene Loughran gave the opening prayer.
ANNOUNCEMENTS
The
Chair announced Ballot Box envelopes were available for distribution to all
those Court Representatives requesting it.
The
name, address, and telephone number of the 2010 Court Representatives and
Alternates should be provided as soon as available to Carol Palermo.
All
2010 Court Representatives and Alternates are invited to the orientation and
election meeting on Thursday, November 19, 2009, at 8:45 AM in the Social
Center. Only the Court
Representatives will cast votes.

APPROVAL OF MINUTES OF OCTOBER 7, 2009, RESIDENTSÕ COUNCIL MEETING AND
APPROVAL OF AGENDA FOR TODAY
On
motion duly made, seconded, and unanimously passed, the Minutes of October 7,
2009, were approved as submitted.
The Proposed Agenda for the ResidentsÕ Council for November 4, 2009, was
distributed to each Court Representative present, and on motion duly made,
seconded, and unanimously passed was approved.
STAFF REMARKS
PETER DYS
Mr.
Dys reported briefly on his recent meetings in Tallahassee where he was
involved in the GovernorÕs Continuing Care Advisory Council regarding aging
issues, and in particular Florida Statute 651 which governs residents and
providers of life care communities.
The
way Shell PointÕs ResidentsÕ Council operates makes Mr. Dys proud. He heard of other Councils that have
many positions sit empty because of lack of interest. That Chapter of the State Statute which governs facilities
such as ours will be going through a number of changes this year and could have
huge implications regarding the operations of facilities. The facilities are so dramatically
different throughout the State it has been very difficult to have it distilled
down to a document that will not hurt any organization, and everyone is
interested in getting more money.
This is of greatest concern with this being submitted to the State at
this time. The State is in dire
financial condition; looking for every nickel it can find. A Bill submitted to the legislature
which would be financially beneficial to the State, would meet some of their
agendas. Some major concerns are
issues such as taxing Founders Fees and Monthly Maintenance Fees which have
been on the table and frequently discussed as an option in the past. Our State
Association, the Office of Insurance Regulation, and the StateÕs Residents
Association have all agreed on the documentation that is done and we are hoping
it goes through untouched. Residents will be kept informed.
Mr.
Dys read a portion of a letter conveying the thanks and appreciation of Richard
Riley, Vice President of FineMark Bank, to the ResidentsÕ Council of Shell
Point.
The
ResidentsÕ Council has hosted meetings and introduced FineMark staff to
residents of each Court. The
ResidentsÕ CouncilÕs dedication to insure the high quality of life at Shell
Point is to be commended. FineMark
sends its regards to the ResidentsÕ Council.
Mr.
Dys is very pleased with the reception of FineMark by the residents and by the
performance of the bank which understands service to the customer and it will
show in the satisfaction of our residents as well as in the deposits.
There
will be a quiet opening of FineMark in the next few weeks. The Grand Opening is scheduled for
November 30 and December 1.
Regarding
apartments at Shell Point that are being prepared/renovated for new
residents: Please do not Ōtour
these apartmentsĶ. The doors of
these apartments are left unlocked and open during the daytime hours so that
workers have easy access. Such units are to be locked by Shell Point in the
evening. However, it has been
noted that some residents have been going into and out of the apartments. This is an invasion of privacy for the
new owners; it is a situation open to liability for folks walking around the
apartment during renovations; and it is open only for staff. Please enter your neighborÕs apartment
only upon being invited to do so.
Since
the fire at Sundial, a number of residents have inquired regarding insurance
coverage. Shell Point owns the
carpets, draperies, appliances, etc. in each apartment. These items are covered under Shell
PointÕs insurance coverage.
HOWEVER, residentsÕ personal property is each residentÕs
responsibility. In addition, it is
important to maintain LIABILITY COVERAGE.
Most Tenant Insurance covers personal property as well as liability
insurance. Please review the
Residents Manual regarding Tenant Insurance. Residents are strongly urged to maintain Tenant Insurance
with LIABILITY COVERAGE. If
someone is injured in your apartment, that is the residentÕs liability. If the residentÕs action/negligence
(overflowing water in bathtub, fire on the stove) creates damage to the residentÕs apartment OR TO ANOTHER
RESIDENTÕS APARTMENT, that becomes the NEGLIGENT RESIDENTÕS LIABILITY. In those cases, that becomes an
insurance company issue, not a Shell Point issue.
Shell
Point will send out information to residents during the next few weeks,
clarifying this matter to every resident.
This could include Shell Point working out a possible contractual
relationship with an insurance company that would come in and provide
competitive rates for residents for Tenant Insurance coverage. Residents would have the option of
choosing this insurance or maintaining current coverage. REMEMBER TO OBTAIN/MAINTAIN THE
LIABILITY SIDE OF INSURANCE COVERAGE.
At
the June 2009 Quarterly Meeting, it was announced that for fiscal year
2009-2010, there would be no increase in Monthly Maintenance Fees. It
is important to clarify that Shell PointÕs FISCAL YEAR is from July 1st
through June 30th of each year. ((Please note: a Calendar Year is from January 1
through December 31). For the period in 2010 from January 1 through June 30
THERE WILL BE NO MONTHLY MAINTENANCE FEE INCREASE. The new fiscal year begins July 1, 2010. A determination
will be made regarding whether or not there will be an increase in the Monthly
Maintenance Fee for the period commencing July 1, 2010 through June 30, 2011,
as the budget is put together. A
60-day notice of any increase is required to all residents, so a notification
of the BoardÕs decision will be distributed to each resident no later than May
1 of 2010. Please know that Shell
Point and the Board will do everything it can to hold fees as low as it
can. At his recent meeting in
Tallahassee, Mr. Dys was sitting with numerous providers. No one of them has reported staying
within the Consumer Price Index.
Shell Point is pleased that it is able to do so. Management will always make the
decision as to what is best for Shell Point and that means for residents as
well.
Issues
that were brought up at last monthÕs Resident council meeting:
--Trees
by the Tennis Courts at Woodlands:
Dying trees in this area as well as the slough and other areas have been
girded and this is in compliance with Water Management issues. These are trees not indigenous to
Florida which are regarded as pest-type trees: Australian Pines and Pepper Trees. This is the preferred way to dispose of these trees.
--Request
to provide menus of the Crystal dining Room on each CourtÕs Bulletin Board: Al Slickers is working on
this. The problem arises as to
available space on the bulletin boards and avoiding clutter. Residents are urged to come to
the Crystal Dining Room to determine what is being served. Mr. Richard Maas
suggested installing plastic folders into which the printed menus could be
inserted. Mr. Dys will follow up
on this matter.
--Information
on the new Security Officer, Rob Boyd:
Rob Boyd will speak later today at the ResidentsÕ Council Meeting.
Mr.
Richard Maass had the additional comments:
--Organization
Chart: Requested that this be
updated and submitted to all Court Reps.
--Dying
Trees in Courts: Attention
should be given to various Palm trees which are displaying dead/brown fronds. Mr. Dys stated the palm trees may be
under treatment and being monitored.
Mr. Dys will speak to Steve Morton.
--Request
to update telephone directory of Shell Point Staff: Mr. Dys stated he will distribute the appropriate
Organizational Chart and Telephone Directory at the next ResidentsÕ Council meeting.
It
was reported that at the Island Pond there is a large accumulation of algae
building. Mr. Dys will address
this issue.
The
Chair stated that issues such as these may be reported to 454-2190 - ONE CALL
DOES IT ALL PHONE NUMBER BY Court Representatives as well as residents.
STEVE MINNIEAR
Mr.
Minniear distributed the Morning Assurance Reports (Reminder – any needed
changes should be initiated thought Pat Cunningham @ 454-2299). Regarding the update on the census, it
is the first time in memory that both Assisted Living Facilities are completely
full with a few units currently in transition from one resident to
another. The Skilled Nursing
Facility has a high census: 31
Medicare and total census of 180.
Swine Flu Update: Lee
County Health Department recently notified Shell Point that we will be able to
order individual doses for the Swine Flu directly from the Health
Department. Shell Point put in an
order for 300 doses to cover all Health Care workers. Apparently, the H1N1 (Swine Flu) vaccine will also be
parceled out in small doses, as has been the case with the Seasonal Flu
vaccine. Shell Point has been told
there will currently be no doses available for those 65 Years of age and older. There is a number of public sites that
will have vaccine available. It is unknown at this time what total will
eventually be available to Shell Point specifically. The County Health Department will continue to make
announcements.
Seasonal Flu: Shell
Point now has 80 more doses. The
phone lines will be opened:
415-5444 and 454-2192.
Residents can call to make an appointment for a Seasonal Flu
vaccine. It will be first call,
first served.
Margie
Pregent, Director of Nursing at the Shell Point Pavilion, was a finalist for
the Rose of Care Award. Margie did
not win the award, but was honored at a very special and beautiful recognition
ceremony where she received a Certificate and a Rose. Congratulations
Margie! Shell Point honors you and you are number #1 with us! The members
of the ResidentsÕ Council congratulated Margie!
Russell
Peters inquired regarding transportation of independent Shell Point residents
who have been discharged from local hospitals. Could we implement a system which would include having the
hospitals contact Shell Point when these folks are discharged so that
appropriate travel arrangements can be made? Shell Point has medical transportation available for
residents to appointments with local medical providers. We do not have specific transportation
for picking up residents upon hospital release. If patients are returning to one of Shell PointÕs health
care facilities, the hospital will initiate transportation and then provide
us with the information concerning date/time. If returning to independent living, the hospital will not
provide us with discharge information unless the resident asks them to do so
(per HIPAA regulations). It appears that this is a complicated situation will
be further reviewed by Mr. Minniear.
INTRODUCTION
OF SHELL POINTÕS NEW SECURITY OFFICER:
Mr.
Dys stated that one of the matters taken very seriously by Shell Point is SECURITY
which takes many forms throughout all of Shell Point, including alarms,
vehicles, visitors, etc. It is
important to procure a special person to address the various issues of security
throughout Shell Point, having the capacity to enforce not only the things that
have to be enforced, but also to do so with some grace and keeps residents and
their friends in mind while doing so.
Our Security Department also appreciates the understanding and
sensitivity as well. Shell Point
has been privileged to retain the services of Rob Boyd. Mr. Boyd has been through his
orientation program. Mr. Dys
introduced Mr. Boyd.
ROB BOYD
Mr.
Boyd addressed the Council, thanking all for the opportunity to come and speak
today. He stated he has already
met with several Court Representatives, and would like to meet with each Court
Representative on an individual basis to discuss various concerns that they
feel are security issues here at Shell Point. Mr. Boyd does not see any major security issues at this time
that needs to have any sweeping change.
Some things may need ŌtweakingĶ and he will rely on Court
Representatives to advise him of those matters. Mr. Boyd promised to be as accommodating as possible to make
those things happen and still have it make sense from an Operation sense. Mr. Boyd stated he is reasonable and
accessible.
Mr.
Boyd has been in Southwest Florida for approximately 6 years coming from Des Moines,
Iowa. His background includes 15
years of service with the Capitol City Police Department in Des Moines; worked
on all different things such as gang units, narcotics, and a very wide
cross-section of law enforcement. He
was involved in very high security with the Secret Service in Des Moines during
the first national primary election that was held there. He served in Special
Operations as a Desert Storm Veteran and Military Police.
On
a personal level, he is married and has two young sons. He is an officer in his church and is
on the Financial Board and Missions Board. Mr. Boyd thinks it a wonderful opportunity for him to be
able to work with Shell Point, a community where you can open a meeting with
prayer.
His
reception from management and all those he has met so far has been great. Please feel free to contact Mr. Boyd at
454-2125. Mr. Boyd reports
directly to Scott Moore. Mr. Boyd thanked the Council for having him here today. He would welcome any comments and would
be happy to take back to his employees any praise from the residents for their
work.
The
Chair thanked Mr. Boyd and welcomed him to Shell Point.
REPORTS OF THE REPRESENTATIVES OF COURTS, KINGÕS CROWN, ARBOR AND
PAVILION
William
Staples submitted a copy of the Larsen Pavilion Resident Council Meeting, Notes
from October 23, 2009.
OLD BUSINESS
Several
matters under Old Business were previously presented.
2009 Employees Christmas Gift Fund Committee Report. Phyllis
Ingalls reported on coming attractions.
November is the BIG MONTH.
KingÕs Crown, Arbor, Commons, Resident Activities Center, donation boxes
are on display. Jane Hoden wrote
an article appearing in the Shell Point Life which advises what is happening
and the purpose. Please notice the
STARS. Newsletters from Oakmont,
Eagles Preserve, contain articles regarding the Employees Christmas Gift Fund. If other Courts have newsletters, it
would be appreciated if articles would be included about the Employees
Christmas Gift Fund.
There
has been numerous Shell Point TV shimmering stars spots. Jared Pike has done a wonderful job and
deserves a big thank you for his fine work. These will continue every Monday throughout the campaign. Jane
Hoden will do several interesting interviews, one of which is with Chuck
Durrell who was last yearÕs Chairman of this Gift Fund. This will appear on November 12 on
Shell Point TV. There will be a
last push requesting contributions on Shell Point TV at the end of November
into the first week of December called ŌThe Last PushĶ. Residents are invited to watch that,
guaranteeing a chuckle! This campaign ends DECEMBER 4TH and there will
be reminders posted in the buildings.
Phyllis
presented a graph indicating the monthly progress of this campaign along with the
results of various advertising and promotions. The goal for 2009 is
$300,000. There was a balance
forward of $5,000 from 2008.
Currently, there is a balance of $158,000. There are hopes that November will really take off in
receiving contributions. Phyllis thanked the Council for having her here today.
The Chair announced that anything the Court Representatives can do to encourage
contributions to this much needed Fund would be greatly appreciated.
NEW BUSINESS.
The
Council Chair appointed Ted Rodgers as Chair of the Nominating Committee for
2010. On motion duly made,
seconded, and unanimously passed, Ted Rodgers was unanimously approved. The 2010 Court
Representatives will select two additional members to serve with Ted Rodgers on
the Nominating Committee
FOR THE GOOD OF SHELL POINT.
Richard
Maas submitted two suggestions:
1. Benches in Administrative Circle. These benches appear to need
refurnishing. Mr. Dys responded
that the benches in the Administrative Circle are teak and should not be
painted. Teak has a ŌweatheredĶ
look and is supposed to look that way. The only refurbishment would be to sand the
benches.
2. Windowsills in Woodlands
courts. These windowsills have
accumulated dirt and should be scrubbed or pressure washed.

The
next meeting of Shell Point ResidentsÕ Council will be held Wednesday, December
2, 2009 at 8:45 a.m. at the Social Center on the Island.
