CALL TO ORDER AND OPENING PRAYER

Chairman Lanpher called the meeting to order at 8:45 a.m. and Donald Miltner gave the opening prayer.

 

ANNOUNCEMENTS

The Chair reminded all Council Members that Minutes of Shell Point Council Meetings may be found on the internet at www.shellpoint.net.

 

The Chair thanked Joyce Heckber, Administrative Executive Secretary, for her excellent work on behalf of the ResidentsÕ Council.

                       

ROLL CALL OF COURT REPRESENTATIVES

 

The roll was called with those present listed above.

APPROVAL OF MINUTES OF JUNE 2 AND JUNE 15, 2010, RESIDENTSÕ COUNCIL MEETING AND APPROVAL OF AGENDA FOR TODAY

 

On motion duly made, seconded, and unanimously passed, the Minutes of the Regular Meeting of June 2, 2010 and the Special Meeting of June 15, 2010, were approved as submitted.  The Proposed Agenda for the ResidentsÕ Council for September 1, 2010, was distributed to each Court Representative present, and on motion duly made, seconded, and unanimously passed was approved, with the addition under NEW BUSINESS of the Election Agenda.

 

STAFF REMARKS

PETER DYS   

 

Pavilion Renovation - This project is on track for completion by the middle to late December 2010.  Agency approvals for the project are expected by mid January 2011 and occupancy is anticipated for late January 2011.     A total of $1,350,000 has been received in either cash or deferred gifts by 54% of the Shell Point residents.  We are short of our goal by $150,000, but hopes are that this amount will have been received by the end of December 2010.

 

Rehab Equipment - $100,000 is planned and $69,000 has been received in contributions.  We have an outstanding amount of $31,000.

 

Parking Areas - The temporary modular building to the west of the entrance will soon be removed and construction of a new parking lot will begin. The parking area will provide not only approximately 23 additional parking spaces, but will be more aesthetically pleasing.

 

Chapter 651 - As a result of the passage of HB 1253, several new disclosure requirements have been added to Chapter 651, Florida Statutes.  The following disclosure requirements apply to continuing care retirement communities licensed under Chapter 651:

 

To Resident Council President or Chair: 

 

á      Within 30 days of the election of a president or chair of the residentsÕ council, a copy of Chapter 651 and related rules;

á      A copy of the full annual statement within 30 days of filing said report with OIR; A staff person (Karen Urbanowicz) must be designated to provide an explanation of the statement.

á      A copy of each quarterly statement within 30 days of filing the statement with OIR if the facility is required to file quarterly.  Shell Point is not required to file.

á      Upon request, a copy of any newly approved continuing care contract within 30 days of approval by OIR;

á      A summary of entrance fees collected and refunds made during the time period covered in the annual report and the refund balances due at the end of the report period.

á      At quarterly meetings where monthly maintenance fee increases are discussed, a summary of the reason for any increase in the monthly maintenance fee that exceeds the most recently published Consumer Price tax index for all Urban Consumers, all items, Class A Areas of the Southern Region.

 

To Resident Council:

 

á      Notification of any plans filed with OIR to obtain new financing, additional financing, or refinancing for the facility and of any applications to OIR for any expansion of the facility.

 

To Prospective Resident:    

 

Before entering into a contract to furnish continuing care, the provider shall make full disclosure, and provide copies of the disclosure documents to the prospective resident or his or her legal representative, of the following information:

 

á      The contract to furnish continuing care.

á      The summary of the last OIR Examination Report.

á      All ownership interests and lease agreements.

á      Make available for review, master plans approved by the board and any plans for expansion or phased development, to the extent that the availability of such plans will not put at risk real estate, financing, acquisition, negotiations, or other implementation of operation plans and thus jeopardize the success of negotiations, operations, and development.

á      Copies of the rules and regulations of the facility and an explanation of the responsibilities of the resident.

á      The policy of the facility with respect to admission to and discharge from the various levels of health care offered by the facility.

á      The amount and location of any reserve funds required by this chapter, and the name of the person or entity having a claim to such funds in the event of a bankruptcy, foreclosure, or rehabilitation proceeding.

á      A copy of s.651.071.  (Contracts as preferred claims on liquidation or receivership.)

á      A copy of the residentÕs rights as described in s. 651.083.

á      A resident or prospective resident or his or her legal representative may        inspect the full reports; the charter or other agreement or instrument required to be filed with the office OIR, together with all amendments thereto; and the bylaws of the corporation or association. 

                  

Posting Requirements:

 

á      Display the certificate of authority in a conspicuous place inside the facility.

á      Post in a prominent position in the facility a concise summary of the last examination report issued by OIR, noting any deficiencies found by the office, and the actions taken by the provider to rectify such deficiencies.

á      Management must verify in writing compliance of all requirements.

á      Residents shall be entitled to at least 7 daysÕ advance notice of each quarterly meeting.  An agenda and any materials that will be distributed by the governing body or representative of the provider shall be posted in a conspicuous place at the facility.

Communities Without Walls: Mr. Dys stated that there is a growing interest in the continuing care retirement community ÒWithout WallsÓ concept.  Folks who are unable to sell their homes and facilities which are struggling with occupancy are interested in this concept which offers certain benefits of living in a continuing care facility without physically living in that community.  It is gaining momentum and several states have already voted to accept this type of care.

 

Country Inn and Suites: After numerous discussions and meetings regarding this matter, it is hoped, subject to Board approval, that the Country Inn and Suites will be converted to an assisted living facility for non-Shell Point residents.  This concept will be presented to the Board of Directors for consideration and approval, and will be announced at the September quarterly meeting.

 

STEVE MINNIEAR  

 

Lawmakers have delayed the 21% reduction in Medicare fees to physicians until 12/1/10.  There is, in fact, currently a 2.2% increase for the period June 1 through November 30, 2010.  However, at some time, these reductions, which have been delayed, may be converted to action and implemented. A 21% reduction would have created a deficit to Shell Point Medical Center of approximately $200,000.  Residents may write their congressmen and elected officials stating their feeling regarding this matter.

 

Mr. Minniear reported that the Pavilion has 182 beds occupied with 26 Medicare patients.  There are 117 permanent residents and we were budgeted for 110. KingÕs Crown has 118 units occupied with 2 units available.  The Arbor has 130 residents and is full.

 

The Pharmacy and Medical Center are closed for Labor Day, Monday, September 6, 2010.

 

Flu ShotsShell Point has received a limited number of flu shots.  National pharmacies such as Walgreens are receiving larger quantities.  As these flu shots become available at Shell Point, they will be administered.  Watch for information on Shell Point TV and postings.  If residents have immediate concerns, feel free to get flu shots at offering pharmacies.

It was announced that Margie Pregent, Director of Nursing at the Larsen Pavilion, has resigned to move to Cleveland, OH.  Her last day is September 23, 2010.  She has been a great asset to Shell Point, with strong clinical and operational expertise.  She will be greatly missed by staff, residents, and volunteers, and we wish her well for the future.

 

SCOTT MOORE

 

Internet:  Mr. Moore stated that the Shell Point Internet went out the day the switch-over to Century Link occurred, which is now up and running.  Mr. Moore has been advised that at the time the switch to Senior TV and HD was made, there were a number of problems, which he was not aware of.  A weak or problem signal caused issues with the HD tuning. Many of our techs have been working on the current problems along with as many as 6 techs and engineers from CenturyLink.  The sound problem has been resolved, and the music channels are back.  Problems involving channels that were blacking out and coming back have been fixed. It was noted that HD issues are not occurring on the Island even though ComcastÕs excessive cost requests were due to the age of the Island.  The Island is not experiencing the problems of the new buildings.  The problems in the new buildings involve the fiber converters, Quam digital signal, 256, 64 and 128. 

 

It is important to re-program television channels as well as remotes.  There are 1550 units with as many as 2 – 5 television sets per unit – resulting in taking longer than expected, as each television set problem is being addressed.  Channels over 100 are operational and the Music channel was back on Friday. Residents are encouraged to call 454-2190 with any concerns. The techs, general maintenance, and the Call Center are all working to correct the existing and remaining problems. 

 

Numerous residents have inquired regarding the ability to upgrade.  Communications will occur relative to upgrades as soon as the basic cable has been stabilized. 

 

Security:  Security has a new look:  new uniforms will more readily identify the Security personnel as they are visible roving through buildings and throughout the campus.   More intense attention is being given to security, including staff, training staff, electronic reporting, and fire and maintenance training. 

 

The security system will be upgraded and new black bar codes will issued without the name of Shell Point.  This assures greater safety for residents who are off campus. Eventually camera monitoring will be included in the much more sophisticated security system. Consideration is being given to golf carts and bicycles going through the gates to have hand-held cards that can be swiped, especially at Eagles Preserve for residents using the fitness center. 

 

Recycling:   Lee County recently spent $6 million to retrofit its facility which includes new screens, sorters and optical scanners that sort recycled items.    This retrofit system allows recycled items to be comingled and not separated as in the past.  This negates the need for the customer to separate plastic, metal, glass, and paper items.  There was no reduction of manpower with the retrofit; it did increase the number of tons per hour processed.

This has no impact on Shell Point.  Shell Point will continue to collect recyclables, but soon it will no longer be necessary to separate recyclables here at Shell Point with the exception of batteries. Remember also, that garbage must be kept separate from recyclables.

 

Shell Point plans to inform residents through SPTV and Shell Point Life as well as postings that it is no longer necessary to separate recycled items.   Existing signage in the recycling areas that identifies individual paper, plastic, and glass recycling containers will be removed.  Remember never to put trash in the recycle bins.

 

REPORTS OF THE REPRESENTATIVES OF COURTS, KINGÕS CROWN, ARBOR AND PAVILION

William Staples submitted a copy of the Larsen Pavilion Resident Council Meeting, Notes from August 5, 2010, a copy of which is attached to these Minutes.

 

OLD BUSINESS :

A.  Recycling Issues and Changes – Previously addressed.

B. Update on Orientation Planning – John Schulke who chaired the committee responsible for orientation material and procedures for the benefit of New Court Representatives, submitted a New Court Representatives Orientation Program outline as well as a Court Representatives Handbook contents page, copies of which are attached to these Minutes.  These distributions represent the latest version of orientation material. 

 

The goal is to provide useful reference material to new Court Representatives.  One very significant aspect is the independence of each Court to operate in a manner that best fits its own style.  Material to be distributed to all new Court Representatives on orientation day as part of a Court RepresentativeÕs Handbook should contain the following:

 

1.         Bylaws of the Shell Point ResidentÕs Council

2.         Call Center Procedure for Residents and Court Representatives

3.         Shell Point Organization Chart

4.         New Representative Orientation Program Outline

5.         Resident Support Services summary, including Case Manager Court Assignments

6.         List of helpful contact numbers

7.         Court Representative Duties as Pertains to Shell Point Morning Assurance

             Program

8.         List of New Court Representatives

9.         Pet Policy

10.       Other material may be available on request by those interested, including

             examples of how some Courts handle common tasks such as Court volunteer

             organizations, fire safety procedures, court rosters, new resident discussion,

             etc.

 

The Chair announced that typically there will be 6-8 new Court Representatives next year.  He thanked Mr. Schulke for his presentation.

NEW BUSINESS

Election of New Court Representatives - The Chair distributed to each Court Representative a package containing all relevant information concerning the duties and procedures for the election of new Court Representatives and asked that all current Court Representatives comply with the procedure.   If any new Court Representative has a question, please feel free to call the former Court Representative or Bill Lanpher at 454-5185.

 

SUGGESTIONS FOR THE GOOD OF SHELL POINT 

 

1.      Request was made to address the noise at the Island swimming pool resulting from booster pumps/tanks.  Currently this matter is being addressed and to date 40 Schefflera bushes have been planted, to be followed by fencing and sound proofing.

 

2.      The area near Harbor Court is also being addressed.  This area is not aesthetically pleasing for residents or guests.  The garden center/nursery is in the process of being moved to an area near the Chiller Plant and should be completed in October.  The trailer will be removed.  The entire area will be cleaned up by Thanksgiving.  The parking lot will be completed during the next fiscal year.

 

3.      It was brought to the attention of Mr. Moore that some residents have received messages on their answering machines regarding providing emergency data into a Lee County Emergency Database.  Rob Boyd, Security Manager has investigated this situation and has offered the following:

 

            ÒThis is a legitimate recording.  Lee County Emergency Management has the

            ÔCode RedÕ system to disseminate important information to the community

            in a timely and efficient manner.  The recording requests individuals that would

            like to be on the system to visit their webpage www.leeeoc.com and click on the

            ÔCode RedÕ tab to enter their contact info.  They would then start receiving

            Messages from Emergency Management of Lee County.Ó

 

HOWEVER,  Shell Point residents are advised never to provide any personal information over the telephone until the message has been  investigated and they know the request is from a legitimate source.

Mr. Moore stated that ÒCode RedÓ is no longer used at Shell Point.  Hand delivery of flyers to each unit has been more effective than Code Red. 

 

4.      Following up a discussion regarding inefficient dishwashers, it has been reported that Consumer Report September 2010 revealed that all manufacturers of dishwashing products have reduced the phosphorous from 7-8% to 0.5% due to a change in the law.  Sixteen states have required this change.  This change effects the pH change in water.

 

5.      It was noticed that the CMAF flag at the entrance to Shell Point was flown at half mast.

 

6.      One area which is very difficult to address and which seems to have no solution for each resident is the fire alarm system.  For a variety of reasons, including inability to hear, inattention to alarms, physical disabilities, and/or impaired hearing, the fire alarm is not heeded by all residents.  Mr. Dys gave assurance that the system is working perfectly.  The Fire Department arrives usually within 3-5 minutes of receiving the alarm.  Consideration should be given to conducting a fire drill in each Court once a year, and develop a procedure to be followed in the event of a fire.

Notification of Compliance

As a result of the passage of House Bill 1253, the Chairman of the ResidentsÕ Council has received a copy of RA-ADD 88040 8/16/10 Addendum to the Type A Resident contract Regarding Private Rooms in Skilled Nursing and a copy of Chapter 651 that is effective as of July 1, 2010 and related rules 690-193, Florida Administrative Code.  These documents are on file in the Administrative office.
