CALL TO ORDER AND OPENING PRAYER
Chairman Dick Rockstroh called the meeting to order at 8:45 a.m. and Joan Perry offered the opening prayer.
ANNOUNCEMENTS
The Chair made the following announcements:
1. Introduction of Linda Nickerson, Recording Secretary, and welcome new and existing Court Representatives.

The roll was called with those present listed above and each Court Representative stated the number of years each has been at Shell Point.
APPROVAL OF MINUTES OF December 3, 2008, RESIDENTSÕ COUNCIL MEETINGS AND APPROVAL OF AGENDA FOR TODAY
Mr. Richard Maass indicated that he had been misquoted in the Minutes of December 3, 2008, regarding his reference to Òplacing recycle containers in the refuse roomsÓ. The Minutes should have reflected his statement as Òplacing recycle bins in the Òmail room areasÓ. Mr. Maass will re-submit his document. A motion was made and seconded that the Minutes be approved as amended and passed unanimously.
A motion was made, seconded, and unanimously passed to approve the Minutes of the 2009 Council Election Meeting held on December 3, 2008.
There were no objections to the Proposed Agenda for the ResidentsÕ Council for January 7, 2009, distributed to each Court Representative present.
The Chair welcomed Cindy OÕGrady who introduced Jodi Phillips, a representative of United Way of Lee County, relative to the Shell Point Campaign for 2009. Ms. Phillips thanked the residents of Shell Point for their fine financial support in 2008. Three people in Shell Point gave $10,000 each included in the total of $70,000+ contributed to United Way in 2008. She stated that there is a greater need this year. Shell Point residents are really engaged in their community for which Ms. Phillips thanked them. Many Shell Point residents have contacted United Way to inquire how they could get involved; how they can help. . United Way motto this year is ÒLive UnitedÓ - to give, to advocate, and to volunteer, which is what so many Shell Point Volunteers do. . Ms. Phillips is looking forward to a wonderful campaign and invited residents to contact her if they have any questions.
Carol Palermo, a resident of Royal Bonnet, presented a report on her involvement with allocations involving the United Way. United Way helped almost 300,000 in Lee, Hendry, and Glade Counties. There are 70 agencies involved with the United Way. Three human service clubs of concern to her group were (1) Public Schools Enrichment Partnership which addresses children who probably will not get through school due to low income families and is associated with the Florida Gulf Coast University; (2) Island Coast AIDS Network which addresses people at risk for HIV and AIDS prevention services, teaching and educating. It has a Harry Chapin Food Bank; and (3) YMCA in Lee County.
United Way packets will be distributed to Shell Point residents January 15; the campaign runs through March 1.
STAFF REMARKS
TIM FICKER
Mr. Ficker wished the Council members a Happy New Year and welcomed the new members and the continuing members of the Council. He expressed the appreciation of Administration to all Council members and the work they do to improve communications between Shell Point residents and the leadership of the organization.
Mr. Dys is out of town and sends his apologies for not being able to attend this meeting.
The CARF-CCAC Assessment scheduled for January 12-14 will be a 2-1Ú2 day process. Residents have been notified of the assessment. Administration has been involved in a yearÕs preparation including voluminous binders, weekly steering committee meetings and other meetings and participation in preparing documents for this meeting. Commencing Monday, there will be numerous meetings; dozens of separate meetings, tours, walkarounds. One surveyor on the team will be solely responsible for three additional certifications for stroke care, dementia care, and person centered care. If approval is received for these three certifications, Shell Point will be the first in the nation to do so, of which we will all be very proud.
Mr. Ficker stated that the assessment group is here at our invitation. We want to treat these folks with the utmost respect. They are not unwelcome guests. We pay to be part of this group; and we are grateful for these folks coming. We are also really grateful to get this process behind us and it has taken a number of people doing a yeomanÕs work. We feel it will be over very quickly.
Many residents will meet and see these folks, will be part of a focus group, and it will be a very tight time schedule. Also an Exit Conference will be conducted at the very end in the Village Church on January 14th from 11:45-12:30PM, which will include not only staff, but also the focus group and all residents. Assessors from CARF-CCAC will provide a preliminary report on their survey visit.
The Resident Focus Group for CARF-CCAC will consist of continuing 2009 Court Representatives who also served in 2008.
Please note that an Auxiliary Annual Meeting has been scheduled for Wednesday, January 14th, at the Village Church, at 1:15PM so there will be a quick turnaround for those wanting to attend both meetings. Hopefully, those attending the Exit Conference will stay for the Auxiliary Meeting. Dr. Judah Ronch, well known for his writing and program development in the area of Person-Centered care, will be the Guest Speaker at the Auxiliary Meeting. Dr. Ronch will also do two training sessions with our Pavilion staff on person centered care. All this will make for a great day.
Bank of America is leaving in the capacity it is in now. Bank of
America has agreed to stay in a part time capacity as long as we need them. Mr. Dys and Tim Lochridge, CFO are in the process of handling a number of proposals from various banks who have contacted us. Within the next few months options for the best bank to serve Shell Point will be considered.
Mr. Maass congratulated the Shell Point Life magazine staff for the excellent article covering the medical services here at Shell Point. Mr. Ficker acknowledged a great job with the magazine and was really impressed with how well they covered so many aspects of the medical services.
STEVE MINNIEAR
Mr. Minniear offered congratulations to Mr. Rockstroh and the new and continuing members of the Council and acknowledged that it is a great service provided by the Council.
Mr. Minniear extended apologies from Joy Darnell, Pharmacist, for not getting out promised information. Pharmacy has been stretched to the limits with occupancy of the Pavilion, but she will get out the information as soon as possible.
Invitations to the Courts for a tour of the Pavilion will be sent out very shortly. Three days in January: January, 28, 29, and 30th; however, no individual Court dates are available at this time.
The Assisted Living Facilities are very full. The census has been up greatly. We are thrilled with the increase in census. KingsÕ Crown has 116 apartments that are full; Arbor has 128 units that are full. Between the two, there are 244 units occupied. In KingÕs Crown there are 2 open and 2 being used as part of the remodeling process, one used as an interim nursing station and staging area station; in the Arbor 1 unit is open and in the process of being filled. We have been very busy there.
Renovation of the Pavilion was completed as of the middle of December and actually started taking in residents in to the first floor as it opened - the 11th and 12th of December.
With the opening of the first floor, census has skyrocketed.
We are having a Professional Community Open House on January 20th that will allow us to introduce the renovation to folks who have not been to Shell Point for probably a number of years. We have invited doctors, case managers, nurses, office folks, to come in and see it and we have gotten a number of RSVPÕs back so we know there is some high interest in it. In conjunction with that, the last 30 days seem to have been directed by God. We re-opened the Pavilion on the 11th; within 4-5 days after that we got the information about the 5 STAR RATING and also being the only 5 STAR facility in Lee County, which generated interest in Shell Point. We were able to include a really nice article about the 5 STAR RATING in the Shell Point Life. Pam Saltsman, Admissions Coordinator for the Pavilion, stated all calls to her have mentioned the 5 STAR RATING. That information has gotten out. It was a nice article in the Shell Point Life. The article in the News-Press which is still on line, has just been absolutely wonderful for us. Thanks to Sherry and her staff.
The 5 STAR RATING is a combination of three areas that are looked at: (1) Health Inspections for past 3 years. Last one gets highest weight; (2) Quality of Measures each nursing home facility receives which are dependant upon very specific information we are required to send to the Federal and State governments regarding the type of care provided to each of our residents. That information is also utilized to direct them when they come in to do surveys. It is very specific information which is also compared to other facilityÕs information concerning medications, how many people have open wounds, and other medical indicators. There are comparative ratings they look at with staffing has more weight than the other two. Even with the struggles related to the building inspection people and safety codes, we received the 5 STAR RATING. I am incredibly proud of Sherry and her group. Also thanks to the Pavilion Auxiliary who worked with them to make the 5 STAR RATING happen.
The Chair and the Council Members congratulated Mr. Minniear and his folks in obtaining the 5 STAR RATING and gave special mention to the Auxiliary for its assistance.
A Health Care Expo will be held January 15 from 9 - 11:30 AM in the Village Church. The various departments will be represented and will include some information concerning VA benefits. There will be 4-5 speakers present.
On January 23 from 10:15-11:30AM at the Village Church, Mr. Dys will re-do his presentation of about a month ago concerning the Pavilion renovation and will talk about the Rehab Center and Pavilion Administration Building (two separate buildings).
SCOTT MOORE
Mr. Moore greeted the members and wished everyone a Happy New Year. Mr. Moore thanked those present - new and continuing - for making communications between Administration and the residents possible.
Mr. Moore spoke of the change to Digital TV scheduled in February. Television is going from Analog to Digital. Only those residents who have rabbit ears or an antenna for their television sets will need an adapter box. The majority of residents will not need an adapter box. In response to inquiries from residents regarding more cable services - Sports package, HBO, Mr. Moore stated that in the very near future he will have more details regarding this service. Although it could not be done in the past, Shell Point will experimentally be going with Direct TV which has the most to offer. It will be at a cost to those interested in this enhanced service and not part of Shell Point Cable TV. You will learn more about this in the next month.
Shell Point is not promoting or advertising Direct TV and we are not making anything in the deal. We are pretty sure that all of the audio services will be available as well. What is available now will remain and be in conjunction with the Direct TV. Shell Point TV, the Church channel, will continue. All channels that are now High Definition will remain High Definition after the conversion. You must have a television that receives High Definition in order to receive the channels that are broadcasting in High Definition. The details over the next months will be given to this group and then made available to all residents in detail. Cable to Palm Acres residents will be addressed later.
Grade stakes along the property between the Woodlands and the Island are not on Shell Point property. They are survey stakes which appear periodically Ð every 6 months to a year Ð when there is someone interested in that property.
Mr. Ficker introduced Bill Skinner who has taken a great interest in recycling and has worked with the staff in that regard over the past year or two.
BILL SKINNER
Mr. Skinner appreciated the opportunity to speak today about recycling. He has been working on recycling at Shell Point for 3-1Ú2 years and is impressed with what the management at Shell Point has been able to do with the challenges it has. There are 73 different points where our 2100 residents can put their recycled products which are emptied 5-6 days a week and are taken to two 20 cubic yard containers - one on the Island and one that services all other areas. A total of 3 recycle containers are taken weekly by our contract hauler to the Lee county recycling center at no cost to Shell Point versus the cost of our trash hauling which is approximately $82 per ton. The more we recycle, the more we save.
Some products we are recycling which you may not think about are:
-Water - we are getting water back - we are using water which is not drinkable for landscaping.
-Stamps - are a big issue at Shell Point and generate a lot of income - the Stamp Ministry generates about $100 a day for the stamp project.
-Tabs on Aluminum Cans - we recycle for the Ronald McDonald House and it is very lucrative for them.
-Steel from Apartment Prep - Recycled and sold and Shell Point gets funds from that.
-Eyeglasses and Cell Phones.
-Corrugated cardboard - baled and sold and Shell Point gets a little money for that.
-Junk mail, magazines, cereal boxes, glass, plastic metal - re cycle.
Lids and caps - off or on - do not make any difference. Rinsing - just briefly rinse out jar or can to control insect problem. Milk Cartons - Do not recycle.
If you have a question as to recycle or not recycle, RECYCLE!
The two worst things you can do in regards to recycling are:
1. Co-mingle paper, plastic, and glass in a plastic bag and deposit into the recycle container. You almost force employees to put that in the trash because they cannot go through that and separate it.
2. Fill a Cardboard Carton with products and leave it out. Employees will have to put that in the trash because they cannot take the time to separate the items.
If the corrugate goes into the trash, we have to pay to have it hauled.
Do not put glass in the trash - it is heavy and we pay for that. Recycle glass. Put all broken glass in the trash; Styrofoam containers may also be put into the trash.
Mr. Skinner will be available to speak at the various Courts regarding recycling and passed around a sign up sheet for the Court Reps to schedule a presentation at their court.
Hazardous materials (diabetic supplies, etc.) are highly regulated and there are collection points at the fire departments. There is currently no provision at Shell Point for individual healthcare products. Disposition of these products is the individual residentÕs responsibility.
Batteries - A, AA, C, and D go through the furnace and can be put in the trash. Fluorescent bulbs - there is a Shell Point collection point on the Island for changed-out bulbs. Anything electronic that plugs in that you want to get rid of, call 454-2190 and someone will come and get the item.
Mr. Skinner thanked the Council members.
Mr. Ficker thanked Mr. Skinner for all the effort he has put into this. Mr. Skinner will do a program on recycling on January 18 on SPTV which will run throughout the day. There will also be an Academy presentation by Mr. Skinner that will be scheduled at a later date.
REPORTS OF THE REPRESENTATIVES OF COURTS, KINGÕS CROWN, ARBOR AND PAVILION
1. Bill Staples reported on the December 2008 Larson Pavilion Resident Council Report, a copy of which will be submitted to the Secretary.
OLD BUSINESS
Christmas Fund Distribution
Chuck Durrell reported on the final Christmas Fund Distribution. We exceeded our goal of a $450 gift to each full time employee. The amount given was $480 distributed to almost half the employees; this is $30 more than goal. The others received a prorated amount. We raised over $300,000, of which $296,000 was distributed to the employees this year. The remainder is held as reserve for next year.
Without the valuable help of his committee - Herb Wilcox of the Island, Betty Miller of Woodlands, and Myrtle Hearn of Eagles Preserve, we never would have reached these numbers. Also of value were suggestions from The Chair and Council members who made contact with their residents, staff members who did everything they were asked and then some, and most of all the tremendous attitude of the front line employees and supervisors who made our lives a little easier at Shell Point.
Mr. Durrell recognized the wonderful job that Joan Perry did in organizing the all important function of distributing gifts. In her report, Joan Perry stated that on December 12, forty-eight people distributed monetary Christmas Gifts from the residents of Shell Point to 849 employees. Special thanks were sent to Jenn Memoli of Human Resources for her help. The Chair thanked Mr. Durrell and his committee and stated they had every reason to be proud.
The Chair read two thank you letters from recipients of the Employee Christmas Gift. These letters are representative of the sentiments of so many employees. The Chair again thanked everyone for their efforts.
NEW BUSINESS
The Chair circulated the proposed schedule for Funding Appeals, a copy of which is attached to these Minutes. It is the same list as 2008 but with different dates. On motion duly made and seconded, the Funding Appeals was unanimously passed.
SUGGESTIONS FOR THE GOOD OF SHELL POINT
Pet Policy
Warren Goodell addressed the concern of residents not following the Pet Policy of Shell Point.
Steve Minniear stated that they are planning within the next 60 days (Feb. 13th at 10:00am in the Village Church) to have a meeting of all pet owners to go back over their understanding of the policies -- when pets have to be carried; when they are allowed to be on leashes.
Mr. Minniear stated he knows that he does not have a complete listing of all pet owners. Anytime we see a pet or we are made aware of a pet, we check our data base to make sure they have registered the pet and have paid the non-refundable $250 pet registration fee. We are becoming more intentional in the enforcement of our policy and are having one-to-one meetings with different residents who have pets that are not being compliant. Most of it has to do with people who are not carrying their pets when they are in common areas. Pets cannot be running around on a leash in a common building area or on an elevator due to the possible trip hazard of other residents. We are recommending pet carriers (even ones with wheels) if residents physically do not have the strength to carry an animal.
Ms. Palermo stated that every pet is listed on the Hurricane Information Form. The form asks if there is a pet so the information should already be available to the Court Representative. Mr. Minniear stated that is a great idea and he will have Rita Southern check her data base. She is responsible for the Pet Policy and the enforcement of it through the Case Managers. There are very few weeks that go by that there isnÕt at least one complaint about pets being inappropriate somewhere. Mike Klein stated that Shell Point does have a Pet Committee which has not had a meeting for at least 5-6 years. This is exactly the type of problem that the Pet Committee is supposed to deal with. Steve stated that they will get a meeting set up.
Beach Area
The next item for discussion related to the sandy beach. Nancy McDowell stated she has noticed that the sandy beach area has become increasingly degraded and eroded in the 10 months she has lived at Shell Point to the point where it is unsafe for residents and visitors to walk there because of the deep gullies and potholes that are there and the exposure of rocks everywhere. Ms. McDowell wanted to know if our beach is on any kind of regular maintenance schedule to take care of those issues and to keep the beach free from the debris that comes on shore including dead animal carcasses lying on the beach as well as refurbishing the sand. It is especially embarrassing when we have visitors to walk around with them and have our lovely beach in such disrepair.
Mr. Ficker responded that the Grounds Department and Facilities folks keep an eye on it. There are some seasonal activities which we do not try to fix and Mr. Ficker mentioned various situations which do occur periodically. Mr. Ficker will ask them to look at it and make them aware, especially regarding an unsafe situation for walking which is our main concern.
